2. Service Accuracy & Third-Party Responsibility

2.2 Role as Facilitator

Travel Coffee acts solely as a booking and service facilitator for hotels, transport providers, local guides, activity hosts, and other vendors. We do not operate these services directly unless explicitly stated.

Accordingly:

  • We are not liable for the operational performance, conduct, or service delivery of third-party vendors
  • We do not assume responsibility for cancellations, delays, mismanagement, or any deficiency in service offered by external parties
  • Any disputes, claims, or refund requests relating to third-party services must be directed to the respective vendor

Travel Coffee will, however, support customers in escalating such issues where feasible, but cannot guarantee outcomes.

2.3 Service Availability

Travel Coffee does not guarantee uninterrupted or error-free access to its website, booking platform, or mobile app. Technical glitches, maintenance periods, third-party outages, or force majeure may impact service availability.

We are not liable for:

  • Booking failures caused by connectivity issues or third-party payment failures
  • Errors arising due to caching, outdated links, or user device/browser configurations
  • Inaccurate display of prices or availability due to real-time system delays

3. User Responsibility & Assumption of Risk

3.1 Personal Responsibility

By using Travel Coffee's platform or booking services, users agree that:

  • They are responsible for reviewing all details of a trip before making payment, including but not limited to itinerary structure, inclusions, exclusions, cancellation terms, and documentation requirements.
  • They are solely responsible for arranging and maintaining valid travel documents such as identification, passports, visas, vaccination records, and insurance (unless otherwise agreed in writing).
  • They are responsible for complying with local laws, customs, and safety regulations at the destination.

Travel Coffee is not liable for trip disruptions or losses arising from the user's failure to comply with documentation, legal, or operational requirements.

3.2 Health, Fitness & Safety

Customers are expected to evaluate their physical and mental fitness before participating in any tour, adventure, trek, or activity booked through Travel Coffee. Certain trips may involve strenuous activity, high altitudes, rural conditions, or limited access to medical support.

Travel Coffee:

  • Does not provide medical advice, fitness assessments, or health clearance
  • Is not responsible for injuries, illness, loss of belongings, or travel disruption due to pre-existing or undisclosed medical conditions

Customers participate in tours and activities at their own risk.

3.3 Voluntary Participation & Risk Acknowledgement

All users acknowledge that travel involves inherent risks, including but not limited to:

  • Road delays, accidents, or infrastructure issues
  • Changes in weather or environmental conditions
  • Delays due to airline, rail, or transport schedule changes
  • Unforeseen political, health, or security events at the destination

By booking with Travel Coffee, the user voluntarily assumes these risks and agrees that the company shall not be held liable for delays, cancellations, or discomforts arising from such conditions.

4. Intellectual Property & Content Usage Disclaimer

4.1 Ownership of Content

All content available on the Travel Coffee website, mobile application, social media pages, itineraries, and marketing materials — including but not limited to:

  • Text, blogs, destination guides, itineraries, and FAQs
  • Images, videos, graphics, and design elements
  • Logos, trademarks, taglines, and brand visuals
  • Package names, activity descriptions, and user interface content

is the exclusive property of Travel Coffee or its licensed partners and is protected by Indian intellectual property law and international copyright conventions.

No part of this content may be copied, distributed, modified, reproduced, republished, or used for commercial or public purposes without prior written permission from Travel Coffee.

4.2 Third-Party Content

Certain content on our platform, such as maps, hotel images, and affiliate widgets, may be provided by third-party service providers or licensors. Such content is subject to the respective terms and usage rights of those entities.

Travel Coffee:

  • Does not claim ownership over third-party trademarks or property displayed on the platform
  • Is not liable for the accuracy, legality, or misuse of such content by end users

4.3 User-Generated Content

  • They grant Travel Coffee a non-exclusive, royalty-free, worldwide license to use, publish, and distribute such content for marketing and promotional purposes
  • Users confirm that they hold the rights to such content and that it does not infringe any third-party rights

Travel Coffee may, at its discretion, feature, edit, or remove such content without obligation to provide notice or compensation.

5. Limitation of Liability & Final Legal Position

5.1 Limitation of Liability

To the maximum extent permitted by applicable law, Travel Coffee, its directors, officers, employees, partners, and affiliates shall not be held liable for any direct, indirect, incidental, special, punitive, or consequential damages, including but not limited to:

  • Personal injury, illness, property damage, or loss
  • Missed flights, delays, or changes in travel plans
  • Emotional distress, mental discomfort, or dissatisfaction
  • Data loss or system errors while using the website or digital services
  • Loss of business, revenue, or anticipated savings

This limitation applies even if Travel Coffee has been advised of the possibility of such damages, and regardless of whether the claim is based on contract, tort, negligence, strict liability, or otherwise.

In all cases, the total liability of Travel Coffee, if any, shall be limited to the total amount paid by the customer for the affected booking or service.

Travel Coffee does not guarantee:

5.3 Legal Jurisdiction

This Disclaimer shall be governed by and construed in accordance with the laws of India, and any disputes arising from it shall be subject to the exclusive jurisdiction of the courts located in Shimla, Himachal Pradesh, India.
